Terms of Use

The terms for using BENARI, accessing content, managing subscriptions and publishing your work.

1. General provisions

These Terms govern BENARI: voiceofbenari.com, app.voiceofbenari.com, open.voiceofbenari.com, the mobile app, library, catalogue, education area, creator accounts and related services. The operator is BENARI INTERNATIONAL LTD., Poole (Dorset), England (“we”). “You” means the person using the service.

By creating an account, taking out a subscription, making a purchase or submitting material for publication, you accept these Terms. If you disagree, do not use the relevant services. Individual offers, publishing agreements, publication rules and subscription conditions may contain specific terms; these apply to the relevant service and do not override mandatory consumer rights.

2. About BENARI

BENARI is a digital library and media platform offering audiobooks, ebooks, podcasts and educational material. It includes works from Voice of Ben Ari (VOBA) and independent authors, publishers and rights holders.

Features, the catalogue and plans may change. The contents and price of a paid offer are determined by the conditions displayed when it is ordered; changes do not cancel obligations already owed to users.

3. Accounts, Google and sign-in security

Some features require an account. Registration and sign-in are available by email and through Google where shown on the sign-in screen. Google sign-in provides your name, email and profile picture; we do not receive your Google password or access to Gmail, contacts or Google files. Your name and picture may become your public BENARI display name and avatar.

Provide accurate information, keep it current and protect access to your account. Do not share access without our permission. Where two-factor authentication is available, you can use a code from an authenticator app. Keep your recovery key somewhere safe: it allows access without the usual second factor. We store its hash and a record of its use, not the key itself.

We may request verification of your email, identity or authority for security, rights checks, payment processing or legal compliance. Access may be restricted where there are reasonable grounds to suspect fraud, a breach of these Terms or a security threat. Contact support if you suspect unauthorised access.

4. Subscriptions, purchases and payments

BENARI offers free and paid options, including Voice, Voice+ and SuperVoice. Plan contents, slots, limits, price, currency, duration, renewal and cancellation conditions are displayed before ordering. Works may be available by subscription, individual purchase, free access or promotion.

A subscription provides a personal, limited, non-transferable right of access for the paid period. A purchase provides access under the relevant offer, without transferring copyright. Restrictions may depend on licences, territory, device and account status. The subscription catalogue may change, subject to paid commitments and applicable law.

Stripe processes web payments. BENARI does not receive your full card number or security code. We retain transaction information, including amounts, currency, tax, the exchange rate used, identifiers and country indicators from payment data. If payment is available through an app store, its conditions also apply.

Cancellations, refunds and payment disputes are handled under applicable law and the purchase conditions. Contact support with your account and transaction details. These Terms do not restrict mandatory cancellation, refund or digital-content remedies; starting access does not itself replace separate consent where the law requires it.

5. Permitted use

Use BENARI lawfully, fairly and within the functions provided. You must not:

  • copy, download, distribute, resell or publicly perform material beyond the permitted functionality and licence;
  • bypass payment, limits, content protection, moderation or security measures;
  • infringe copyright, related rights, personal rights or other third-party rights;
  • publish unlawful, malicious, fraudulent, defamatory or threatening material;
  • disrupt the service, conduct unauthorised security tests, attempt password guessing or collect data automatically without authorisation;
  • impersonate a person, organisation or BENARI representative without authority.

6. Creators, uploads and remuneration

By uploading text, EPUB files, audio, covers, descriptions or educational material, you confirm that you hold the necessary rights or another lawful basis, including public-domain status where applicable. You are responsible for accurate information about the work, rights holders, translation, narration, publisher and price.

You grant a non-exclusive right to use the material as necessary for storage, processing, moderation, display, technical reproduction, sales, subscription access and promotion within BENARI. Additional publishing and financial conditions are governed by a separate agreement.

Application review and payouts may require contact details, identity and address verification, payment details, country of residence and a tax profile: tax residence, individual or company status, legal name and tax number. See the Privacy Policy.

Creators set a work’s price in their account or mark it as free. A payout threshold is selected when applying: £10, £25, £50 or £100. The accounting period is a calendar month. When the threshold is met, including an exact match, payment is scheduled within 45 days of month-end; otherwise the entire accrued amount carries forward. The creator agreement applies, including taxes and permitted deductions.

7. Intellectual property

Rights to BENARI’s code, design, structure, databases, logos, interface and original editorial material belong to the operator or are used lawfully. Rights to works, recordings, translations and covers remain with their respective rights holders. Using the service does not transfer these rights to you.

8. Moderation and support

Uploading does not guarantee publication. We may review material and rights documents, request changes, reject publication, temporarily restrict access or remove material for reasonable grounds, including breaches of law, these Terms or third-party rights.

Chapters and audio tracks of a published book edition cannot be edited. Changing its details, including title, description, cover, price or subscription participation, triggers another moderation review. During review, the edition may be unavailable in the catalogue and library, including to purchasers. Purchasers’ mandatory rights remain unaffected.

Enquiries, moderator comments, decisions and review history are retained as needed for support, rights verification and disputes. To request review of a decision or report an infringement, email info@voiceofbenari.com, identifying the material and your reason.

9. Service operation and liability

We take reasonable steps to operate and secure BENARI, but do not guarantee uninterrupted or error-free service. Maintenance, technical faults and outages affecting connectivity, hosting, payments or other external providers may occur.

Liability is determined by applicable law and the circumstances of the breach. These Terms do not exclude or limit liability for fraud, death or personal injury caused by negligence, or any liability that cannot lawfully be limited. Mandatory consumer rights, including rights relating to paid digital content, remain unaffected.

10. Leaving the service and deleting an account

You may stop using BENARI and request account deletion in the app, on the account deletion page or by contacting support by email. Account ownership must be verified before deletion.

Deletion ends access to your library, progress and settings. Recurring charges for active Stripe subscriptions are cancelled before deletion completes; if cancellation fails, the process does not complete and you should contact support. An app-store subscription, if purchased there, must also be managed through that store.

Certain financial, tax, contractual and request records may be retained where there is a lawful basis. Published works may remain under a valid publishing agreement. Registering again does not restore deleted data. See the Privacy Policy.

11. Changes and a change of operator

This version is dated 18 September 2026. It applies upon publication, but no earlier than that date. We will give notice of material changes or a change of operator through the website, app or email before they apply where required by law.

If the operator changes, notice will identify the new operator, transition date and implications for contracts and data. Separate consent will be requested where legally required. Updating these Terms does not replace consent to optional data processing or cancel existing obligations.

12. Governing law and disputes

These Terms are governed by the law of England and Wales, while preserving mandatory consumer protections in your country of habitual residence. This clause does not remove your right to use courts or other bodies available under mandatory law.

Please first contact support to try to resolve the matter. If no agreement is reached, disputes are dealt with under applicable jurisdiction rules.

This version is available in Russian, English, Spanish, Polish and German. The versions describe the same terms. Please report translation discrepancies so we can correct them. No language version restricts mandatory user rights.
